Weatherbeeta Dog Competition - T&Cs
1 The Promoter
The promoter is: WEATHERBEETA LIMITED, a company incorporated in England and Wales with company number 03006765 and registered address at Unit 9, Somerville Court, Banbury Business Park, Adderbury, Banbury, Oxfordshire, OX17 3SN, England (the “Promoter”).
2 The competition
2.1 The title of the competition is as described on the relevant entry form for this competition, which can be located on the Promoter’s website at weatherbeeta.co.uk (the “Website”), (the “Entry Form”).
3 How to enter
3.1 The competition will run from the "Opening Date" until the "Closing Date" inclusive, the relevant dates and times applicable to the Opening Date and Closing Date are set out on the Entry Form.
3.2 All competition entries must be received by the Promoter by submitting a completed Entry Form on or before the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
3.3 No purchase necessary and there is no charge to register for use of the Website.
3.4 The Promoter will not accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
3.5 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

3.7 The competition entries will be judged by [an independent judge who is not connected to the Promoter and is not an entrant of the competition. The independent judge will select 41 photographs from all the entries that he/she considers to be photographs of the cutest dogs (the “Runners-up”). A panel of [three (3)] judges (including at least one independent judge) shall then review the Runners-up entries to determine the photograph of the cutest dog, which entry shall be the overall winner of the competition. There will only be one overall winner chosen who will win the main prize and 40 Runners-up, each winning a Runners-up prize]. The decision of the panel of judges (acting reasonably) will be final.
3.8 The Promoter will send the full names of the judges to anyone who emails email@example.com within one month after the Closing Date of the competition requesting details of the judges] OR [A list of names of the judges can be viewed on the Website from the Closing Date for a period of  days.
4.1 The competition is only open to UK mainland residents aged 18 years or over, except:
(a) employees of the Promoter or its holding or subsidiary companies;
(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
(c) members of the immediate families or households of (a) or (b) above.
4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.
4.3 The Promoter will not accept competition entries that are:
(a) automatically generated by computer;
(b) completed by third parties or in bulk;
(c) illegible, have been altered, reconstructed, forged or tampered with; or
4.4 Entries on behalf of another person will not be accepted and joint submissions are not allowed.
5 The prize
5.1 The prize, [or prizes (where relevant) are described on the Entry Form.
5.2 The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's reasonable control make it necessary to do so.
5.3 The prize is not negotiable or transferable.
6.1 The decision of the judges nominated by the Promoter is final and no correspondence or discussion will be entered into.
6.2 The Promoter will contact the winner personally as soon as practicable after the “Announcement Date” (as stipulated in the Entry Form), using the email address or other contact details provided by the entrant on the completed Entry Form.
6.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of major prize winners on the Website and/or any of the Promoter’s social media pages and may send the surname and county of major prize winners, to anyone who emails firstname.lastname@example.org within one month after the Closing Date of the competition.
6.4 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter by EMAIL email@example.com. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
7 Claiming the prize
7.1 If you are the winner of the prize, you will have 28 days from the Announcement Date to claim the prize by [responding to the Promoter’s email or other communication and, where applicable, arrange to take delivery of the prize, or where the prize is an experience, arrange a suitable date and time for the experience with the Promoter to take place within 40 days of the Announcement Date.] If you do not claim the prize by this date, your claim will become invalid.
7.2 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 28 days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.
7.3 The Promoter does not accept any responsibility if you are not able to take up the prize within the timescales set out under clause 7.1 or otherwise.
8 LIMITATION OF LIABILITY
8.1 If we are in breach of the arrangements under these terms and conditions, we will not be responsible for any losses that you suffer as a result, except those losses which are a foreseeable consequence of our breach.
9 Intellectual property rights
9.1 You agree that the Promoter may, but is not required to, make your entry available on the Website, social media platforms and any other media, whether now known or invented in the future, and in connection with any publicity of the competition.
(a) there are no identifiable people in any photograph submitted by you as part of your entry;
(b) there are no identifiable brands (including but not limited to logos on clothing, branded toys, food, drinks, etc.) in any photograph submitted by you as part of your entry;
(c) there is only one dog in any photograph submitted by you as part of your entry; and
(d) that you personally took the photograph submitted by you as part of your entry and therefore you own the intellectual property rights within that photograph.
10 Data protection and publicity
10.1 The Promoter will only process your personal information in accordance with the relevant data protection laws (including the General Data Protection Regulation (EU) 2016/679 and the Data Protection Act 2018) and as set out in the Promoter’s privacy notice which is available at weatherbeeta.co.uk/privacy-policy. See also condition 6.3 and condition 6.4, with regard to the announcement of winners.
10.2 By participating in this competition, each entrant agrees to allow the Promoter the right to use his/her name, likeness, picture and other information and content provided in connection with the competition for promotion, trade, commercial, advertising and publicity purposes in all media worldwide including, but not limited to, on television and the internet, without notice, review or approval and without additional compensation during a maximum period of two (2) years.
11.1 The Promoter reserves the right to exclude you from participating in the competition if you have breached these terms and conditions, or if your conduct is contrary to the spirit or intention of the competition.
11.2 The Promoter shall not be liable for any delay or cancellation in the event of any strike, lock out, trade dispute, accident, fire, flood, or any natural disaster or act of God, epidemic, pandemic or any contingency whatsoever beyond the reasonable control of the Promoter affecting the Promoter’s ability to comply with these terms and conditions. The Promoter will however take steps to minimise the impact of any delay. Any such delay or cancellation shall not constitute a breach of the terms and conditions by the Promoter, nor will you be able to claim for any loss or damage howsoever arising as a result of these circumstances.
11.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
